1. Introduction
This Content Removal Policy explains how Nordihaus LLC ("Nordihaus," "we," "us," or "our") handles intellectual property on the website https://nordihaus.de/ and the related services (the "Services"), and how rights holders and other persons can ask us to remove content.
The Services contain our own content as well as content from third parties, in particular property listings with descriptions and photos provided by sellers, real estate agents, or other listing sources. We respect the intellectual property rights of others and expect all users of the Services to do the same.
2. Our Content
Unless otherwise indicated, the design and layout of the Services, our original texts, articles, and guides, and the Nordihaus name and logo are owned by or licensed to Nordihaus. You may view this content for your personal, non-commercial use. You may not copy, reproduce, distribute, or republish it for commercial purposes without our prior written permission.
You may not use automated means, such as scrapers, bots, or crawlers, to systematically copy or extract listings, photos, or other content from the Services, except for search engines that index the Services in accordance with our technical settings.
3. Third-Party Content
Property listings, including descriptions and photos, may be based on materials provided by sellers, real estate agents, or other listing sources. The rights to such materials remain with their respective owners. We do not claim ownership of third-party content displayed on the Services.
4. Seller Responsibilities
When you order a listing package and provide us with a link to an existing listing, a property description, photos, or other materials, you confirm that:
- you own the materials or have obtained all rights and permissions needed for us to use them as described below, including where the materials come from a listing published by a real estate agent or photographer;
- the materials do not infringe the copyright, trademark, privacy, or other rights of any third party; and
- the materials are accurate and lawful and do not contain personal data of other individuals without a valid legal basis.
You grant Nordihaus a non-exclusive, royalty-free right to use, reproduce, translate, adapt, format, and publish these materials on the Services for the purpose of creating and displaying your listing, for the duration of the listing period and for as long as reasonably necessary to remove the listing afterwards.
If a third party makes a claim against us because materials you provided infringe their rights, we may remove the affected content and ask you to provide evidence of your rights.
5. How to Report Copyright Infringement
If you are the owner of a copyright, or are authorized to act on the owner's behalf, and you believe that content on the Services infringes that copyright, please send a notice to info@nordihaus.de with the subject line "Copyright Notice." To allow us to process your notice, please include:
- a description of the copyrighted work you believe has been infringed;
- the exact URL of each page on the Services where the content appears, and a description of the content concerned;
- your full name, postal address, and email address;
- a statement that you believe in good faith that the use of the content is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf; and
- your physical or electronic signature.
If your notice is incomplete, we may ask you for additional information before we can act on it.
6. How to Report Other Content
You may also contact us at info@nordihaus.de if you believe that content on the Services is unlawful or should be removed for another reason, for example because:
- a listing contains your personal data, such as your name, contact details, or photograph, and you want it corrected or removed;
- a listing appears to be fraudulent or misleading; or
- a property has been sold or is no longer available.
Please include the URL of the content, an explanation of why you believe it should be removed, and your name and email address, so that we can process your report and inform you of our decision.
7. How We Handle Notices
- Confirmation: we confirm receipt of your notice by email.
- Review: we review each notice carefully and objectively. Where necessary, we may contact the seller or other person who provided the content.
- Action: if we determine that the content is infringing or unlawful, or that it should otherwise be removed, we promptly remove it or disable access to it.
- Decision: we inform you of our decision. If we remove content provided by a seller, we inform the seller of the removal and the reasons for it.
The removal of listing content following a valid notice does not entitle the seller to a refund, except as provided in our Refund and Cancellation Policy or where required by law.
8. Response by Affected Sellers
If content you provided has been removed and you believe the removal was made in error, for example because you hold the necessary rights, you may contact us at info@nordihaus.de. Please explain why you believe the removal was incorrect and provide any supporting evidence, such as a license or written permission from the rights holder. We will review your response and may restore the content where appropriate. This does not affect any other remedies available to you under applicable law.
9. Repeated Infringement
We may remove listings and suspend or close the accounts of users who repeatedly provide content that infringes the rights of others.
10. Misuse of the Notice Procedure
Please submit notices only if you believe in good faith that content is infringing or unlawful. Knowingly submitting false or misleading notices may result in liability under applicable law. We may disregard notices that are manifestly unfounded or submitted repeatedly without a valid basis.
11. Point of Contact
Our point of contact for users, rights holders, and authorities for all matters relating to content on the Services is info@nordihaus.de. You may contact us in English or German.
12. Changes to This Policy
We may update this policy from time to time. The updated version will be published on this page with a revised Effective Date.
